On behalf of our client, Lemberg & Associates recently filed a complaint in U.S. District Court, Northern District of California, against Milestone Law Group. Our client alleges that, in an attempt to collect a $176 debt to Wells Fargo, Milestone Law Group called and demanded an immediate payment in excess of $700. When our client disputed the amount and asked Milestone Law Group to explain, the debt collector told her that the debt was accruing $54 per day in interest. She alleges that Milestone Law Group told her that, if she did not make a payment, they would treat it as an attempt to “defraud the creditor.” Moreover, Milestone Law Group often called around 8:00 a.m., which our client told them was inconvenient because of her disabled daughter. Nevertheless, Milestone Law Group continued to call at that time. Sometimes, Milestone Law Group called up to five times per day, and sometimes called each hour.
In addition, Milestone Law Group threatened to take legal action against our client, and received a call from someone claiming to be a process server. The “process server” told our client that they were attempting to serve our client with a “sealed document,” and provided a callback number. When our client called the number, it led to Milestone Law Group.
The lawsuit charges that Milestone Law Group violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by calling at a place and during a time known to be inconvenient; by using false, deceptive, or misleading representation in connection with the collection of a debt; by misrepresenting the character, amount, and legal status of a debt; by threatening to take legal action without actually intending to do so; by employing false and deceptive means to collect a debt; and by using unfair and unconscionable means to collect a debt. The lawsuit also charges that Milestone Law Group violated the Rosenthal Fair Debt Collection Practices Act and invaded our client’s privacy.
