On behalf of our client, Lemberg & Associates recently filed a complaint in the U.S. District Court, District of Arizona, against Progressive Management Systems.
Our Client alleges that Progressive Management Systems contacted him on his home phone in an attempt to collect a debt owed by someone who does not live with him. Progressive Management Systems used automated dialers and prerecorded messages when placing calls to our client’s phone. Whenever our client answered the phone, there wasn’t anyone on the line. The message on these prerecorded calls told our client to dial “2” if he was being called in error, and although he followed the instructions and did that, the calls continued. Next, our client sent a letter to Progressive Management Systems telling them that the person they were trying to reach could not be reached at his number. He then asked them to cease all communication with him, but Progressive Management Systems did not stop calling to try and collect the debt.
The lawsuit charges that Progressive Management Systems violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior and by using unfair and unconscionable means to collect a debt. The lawsuit also charges that Progressive Management Systems invaded our client’s privacy.
