On behalf of our client, Lemberg & Associates recently filed a complaint in U.S. District Court, Eastern District of Michigan, against Congress Collection Corp. Our client alleges that, in attempting to collect a debt, Congress Collection Corp didn’t identify itself as a debt collector trying to collect a debt. Moreover, when our client requested information about the debt, the debt collector said, “What, were you injured in an accident or something? You called and spoke with us back in January, you should remember this!” and, “Who do you think you are? I’ve been in collections since before you were born!” and, “You’re a debtor; this is not customer service.”
The lawsuit charges that Congress Collection Corp violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by using abusive language; by failing to inform our client that the phone call was an attempt to collect a debt; and by using unfair and unconscionable means to collect a debt.
