On behalf of our client, Lemberg & Associates recently filed a complaint in U.S. District Court, Western District of North Carolina, against CLX Systems/Westwood Management. Our client alleges that she was contacted by CLX Systems/Westwood Management to pay a $500 debt. Our client told CLX Systems/Westwood Management that she was unemployed and disputing the debt with the creditor. She asked CLX Systems/Westwood Management to send written confirmation of the debt. The debt collector didn’t acknowledge the dispute, and told our client that she was trying to “come up with excuses” in order to avoid paying the debt. The collector allegedly yelled at our client, and our client asked CLX Systems/Westwood Management to stop calling her. Nevertheless, CLX Systems/Westwood Management continued to call.
The lawsuit charges that CLX Systems/Westwood Management violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by using profane and abusive language; by using false, deceptive, or misleading representation in connection with the collection of a debt; by misrepresenting the character, amount, and legal status of a debt; and by using unfair and unconscionable means to collect a debt. In addition, the lawsuit charges CLX Systems/Westwood Management with violations of the North Carolina Fair Debt Collection Practices Act and the North Carolina Debt Collection Act.
