Access Receivables Management: From Our Case Files

On behalf of our clients, Lemberg & Associates recently filed a complaint in U.S. District Court, Northern District of Illinois, against Access Receivables Management. Our client alleges that Access Receivables Management called his cell phone numerous times in an attempt to collect a debt belonging to someone else. During each call, our client told Access Receivables Management that he did not know the person they were trying to reach. Nevertheless, Access Receivables Management continued to call.

The lawsuit charges that Access Receivables Management violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior. In addition, the lawsuit charges that Access Receivables Management violated the Illinois Collection Agency Act, violated the Illinois Consumer Fraud Act, and invaded our client’s privacy.

"The FDCPA is a consumer protection statute and was intended to permit, even encourage, attorneys like Lemberg to act as private attorney generals to pursue FDCPA claims."
