Southwest Credit Systems is based in Texas, and has their fingers in virtually every piece of the debt collection pie. Southwest Credit collections collects on auto loans, home equity loans, student loans, credit cards, unsecured checking accounts, and demand deposit accounts, among others. Southwest Credit Systems is a third-party debt collection agency, but it also collects on behalf of debt buyers – people and companies that pay pennies on the dollar for charged off debt, and then try to squeeze every last dime out of consumers.

As of June 2013, the Better Business Bureau had given Southwest Credit Systems an A+ rating. The BBB had logged 147 closed Southwest Credit Systems complaints over the previous three years, including 46 closed Southwest Credit Systems complaints over the previous 12 months. In addition, the Justia database lists a dozen Southwest Credit Systems lawsuits filed in federal court during the first five months of 2013 that allege violations of the Fair Debt Collection Practices Act.

For example, if you owe a debt, a collection agency has the right to call you – unless you’ve notified them in writing that you don’t want them to contact you. However, they can’t call you any time they wish. They can only call between 8:00 a.m. and 9:00 p.m., unless you’ve told them to call you at another time. A debt collector also can’t call you “at a time or place known or which should be known to be inconvenient to the consumer.” So, for example, a collection agency can’t call you at work if they know your employer doesn’t allow outside calls. While a debt collector can call more than once, if they call you multiple times to the point of harassment, they’re breaking the law. What constitutes calling “too many times” is a tricky question, but generally, if they’re calling more than a couple of times a week, they’re probably violating the law. Similarly, calling and hanging up repeatedly is against the law.
Every single time a debt collector calls you, the collector is required to tell you his true name, that he’s attempting to collect a debt, and that any information you give him will be used for that purpose.
