Rosenberg & Associates

Rosenberg & Associates (formerly D.H. Rosenberg & Associates) operates out of Vienna, Virginia, and Bethesda, Maryland. They seem to have pivoted away from primarily collecting on old payday loans and toward home foreclosures, evictions, and bankruptcies. As of July 2013, Rosenberg & Associates’ website boasted that it was “the most dedicated real estate law firm in the DC Metro area.” Indeed, the law firm has seemingly hundreds of foreclosure sales listed on its website. In addition, the firm handles “creditors’ rights” issues.

The Better Business Bureau has no file on the business, but during the first four months of 2013, there were two Rosenberg & Associates complaints filed in federal court alleging violations of the Fair Debt Collection Practices Act.

Stop Debt Collector Harassment

Fortunately, a law has been enacted to protect consumers from debt collectors who overstep their bounds. It’s called the Fair Debt Collection Practices Act and it outlines the ways debt collection agencies can—and can’t—go about collecting on debts.

For starters, no debt collector is allowed to lie about whom they are when they call. In addition, they are not permitted to threaten to take any action that they don’t intend to take, and even then, it must be legal. For example, a debt collector can’t threaten to send someone to jail because owing a debt is not a crime.

In addition, there is a statue of limitations on debts, and although the debt collector still has the right to try and collect the debt once it’s passed, they cannot threaten to file a lawsuit against you. Check with your state to determine the statute of limitation on your particular debt.

If a debt collector is harassing you, there are legal steps that you can take to stop them. You can file a complaint with your Attorney General’s office, or with the Federal Trade Commission. In addition, you can retain the services of a fair debt attorney and file suit against the debt collector for violating the provisions of the FDCPA. If you win, the judge can award you actual damages, plus up to $1,000.
