Reliant Capital Solutions flies far under the radar. This debt collection agency was incorporated in 2006 in Utah, but operates out of the greater Columbus, OH, area. Their website has fewer than 1,000 words on it so it’s a bit difficult to find out much about the company. However, the local Better Business Bureau gives the company a B+ rating based on receiving 53 complaints in the past 36 months and resolving 47 of them. Reliant Capital Solutions has been sued in federal court 11 times in the past 12 months for allegedly violating the Fair Debt Collection Practices Act. It appears that Reliant Capital Solutions collects on student loans guaranteed by the state of Ohio.
Stop Reliant Capital Solutions Harassment
According to one attorney, Reliant Capital Solutions offered up a classic example of misrepresentation when attempting to contact a consumer. The debt collector from Reliant Capital Solutions left a voicemail message identifying himself as calling from the Ohio Attorney General’s office and saying that he had an urgent matter that he needed to discuss with the consumer. As you might imagine, the response by a consumer getting a call from the AG’s office is significantly different from getting a call from a debt collection agency.
The Fair Debt Collection Practices Act specifically prohibits a debt collector from representing himself or herself as something other than a representative of a debt collection agency when attempting to collect a debt. Claiming to be calling from, or for, the Attorney General’s office is a violation.
When Reliant Capital Solutions was contacted about this matter, they simply said it was a mistake. The state of Ohio is a client of the debt collection agency and the Attorney General’s office is ultimately responsible for collecting on defaulted loans guaranteed by the state. However, this does not make Reliant Capital Solutions a representative of the Attorney General simply because they are contracted by the state.
Debt collection agencies have some pretty Draconian collection tools available to them when collecting on government guaranteed loans. Federal and state income tax returns can be intercepted. Federal benefits that are normally immune to garnishment, like Social Security and survivor’s benefits, can be dinged to satisfy a government debt. Know your rights under the Fair Debt Collection Practices Act, but also know what remedies are available to get out of government debt.
