Stop Debt Collector Harassment
If you’ve been yelled at by debt collectors, you should be aware that the Fair Debt Collection Practices Act prohibits the use of abusive language. The FDCPA is supposed to make the process of debt collection a fair and civil activity. The government knows the importance of businesses being able to collect what is due, but it also recognizes that some collectors use tactics that make loan sharks look like choir boys. As a result, the FDCPA sets standards of conduct for both debt collectors and consumers.
If a debt collector uses the offensive language, keep a log. Write down the time of each call, the name of the collector (he is required by the FDCPA to provide his name) and what was said. If you send a cease and desist letter, by law they have to stop calling you. This doesn’t eradicate any debt you owe, but should stop the harassment.
If the debt collection agency persists, contact a fair debt attorney who can stop the calls and sue them for violating the Fair Debt Collection Practices Act. The law says that the court can award you up to $1,000 and attorney fees.
