As of July 2013, the Better Business Bureau had given JC Christensen & Associates a B- rating, and had logged 99 closed JC Christensen & Associates complaints in the previous three years, including 37 closed JC Christensen & Associates complaints within the previous 12 months. In addition, during the first five months of 2013, there were three suits filed in federal court alleging that JC Christensen & Associates violated the Fair Debt Collection Practices Act.

Stop Debt Collector Harassment

All debt collectors must follow the rules set out in the Fair Debt Collection Practices Act. The Act sets standards for how debt collectors are allowed to try and collect a debt.

For instance, when a debt collector is attempting to collect a debt that is past the statue of limitations, there are certain legal remedies for them that no longer apply. They aren’t allowed to sue you for the debt any longer or report it to a credit bureau. While it’s true that they are still allowed to collect the debt, all they can really do is ask you to pay it. If they threaten to do anything else, they are likely in violation of the Fair Debt Collection Practices Act (FDCPA), and you have the right to take them to court and ask for damages.

One way to find out if a debt is past the statute of limitations is to ask for a debt validation letter within 30 days of receipt of the first collection letter. The credit collection agency will have to send you some information about the original debt, and you should be able to find out when it originated and when you last made a payment. Then, check with your state’s laws to find out if the debt is old enough to qualify.

If you find yourself in a court of law in a suit against the debt collection agency, and you win, the judge could award you up to $1,000 in damages, plus order the debt collector to pay attorney’s fees and court costs.

  1. We have recently received two calls from a rep from this company. First of all, the debt is allegedly my husbands, not mine. So far, despite being told when my husband will be home, the collector has only spoken to me about it. There has been ZERO contact in writing about the supposed 66 accounts they have in collection from one creditor. A major health care provider. When I asked for this information I was told that MY HUSBAND had to request this in writing. The agency apparently only verifies debt if the request is sent via a extremely detailed letter. As in-if I don’t ask for dates, amounts, services provided, etc, they don’t have to tell me. When I contacted the original creditor I was informed that once the account was in collections they had “no access to any information regarding it available to them.”

    In any case-the agent has yet to speak with the person he claims owes the money(my husband) but calls and attempts to get me to agree to payment arrangements. MN is not a joint property state. A spouse is not responsible for the others debts. I am not able to make payment arrangements with this gentleman over the phone and he has yet to have any contact with my husband about it.
