F. H. Cann & Associates is a third party debt collector located in Andover, Massachusetts. The company claims over 100 years experience in collecting debt. Their website claims that its agents are trained in being “helpful” to consumers in debt and references “respectful” interactions and attempts to work with consumers. FH Cann & Associates collects on behalf of a number of industries, including education, financial, medical, gaming, utilities, and insurance. F. H. Cann & Associates notes that they accept accounts of any size and that they are paid on a contingency basis, meaning that they don’t get paid unless they can convince a consumer to pay.

It is odd, however, that FH Cann & Associates claims that it is a woman-owned business, when Frank H. Cann (presumably the “FH” in the company name) is the President and CEO.

As of August 2013, the Better Business Bureau had accorded FH Cann & Associates an A rating. The BBB had logged 13 FH Cann & Associates complaints over the previous three years, including five FH Cann & Associates complaint over the previous 12 months.

Stop Debt Collector Harassment

Know your rights when dealing with debt collection agencies. The Fair Debt Collection Practices Act contains protections and rights for consumers dealing with collection agencies, and collectors sometimes violate its provisions. If you know what those provisions are, you can call the company and force them to treat you fairly or cease contacting you altogether.

First, be aware that certain debt collection agencies collect on subsidized student loan debt for the U.S. government. There are special rules for debts owed to the Department of Education, including the ability of a collection agency to garnish your wages if you fail to make payments as agreed. The rules also require that the collection agency work with you to make your payments affordable and to “rehabilitate” past due loans, so it may be in your best interest to work with the company on these loans.

Where consumer debt, such as old credit card bills, gas card payments, and medical bills are concerned, however, debt collectors must operate within certain limitations. Among other things, they cannot garnish your wages without having gone to court and had a judge sign a judgment giving them the right to do so. If the collection agent suggests that they can take your house or sell your car at auction in order to pay for your bill, there’s a good chance they’re in violation of the FDCPA.

If they refuse to provide contact information for the collection agency, they are also skirting the edges of legality under the FDCPA. The law gives you the right to dispute your debt, and the right to ask the debt collector to cease contacting you by sending a written notice to their mailing address. When a company refuses to provide that information, its agents are obstructing your rights and may be violating the law.

If you are being harassed or abused by a debt collector, you have the right to sue them in civil court. If a judge agrees that they are violating the law, the company could be ordered to pay you damages of up to $1,000, as well as actual damages and your legal costs.
