Stop Debt Collector Harassment

If you are being harassed by debt collectors, you should be aware that you have rights under the Fair Debt Collection Practices Act that protect you from unethical behavior. According to the FDCPA, a debt collector must identify themselves when communicating with a consumer, or any third parties that they contact in their efforts to locate you. It is a violation of the FDCPA for a debt collector to misrepresent themselves by claiming to be a police officer, detective, private investigator, or an attorney. Debt collectors are also prohibited from deceiving a consumer into believing that they are endorsed or represented by any law enforcement office, and they are not allowed to threaten legal action against you unless they are in fact seeking legal action against you to collect your debt.

If you are being harassed by debt collectors, or believe that they have misrepresented themselves in their communications with you, you can report them to the Consumer Financial Protection Bureau and file suit against them for their actions. If found to be in violation of the FDCPA, they could be forced to pay you damages of up to $1,000, as well as your court costs and attorney’s fees.
