Asset Recovery Solutions (ARS Collections)

Asset Recovery Solutions, also known as ARS Collection is a third-party debt collection agency that operates out of Des Plaines, Illinois, and has been in business since 2009. ARS collection agency collects on behalf of a wide variety of clients, including the consumer loan, credit card, auto, and retail industries. Asset Recovery Solutions also appears to be a debt buyer, or collects on behalf of debt buyers who have purchased charged-off debt portfolios – likely for pennies on the dollar.

Asset Recovery Solutions Complaints

Although the Better Business Bureau has logged relatively few Asset Recovery Solutions complaints, as of May 2013 the BBB gave ARS an “F” rating. Among the reasons the BBB cited for its low rating were that the debt collector failed to respond to one Asset Recovery Solutions complaint and that three Asset Recovery Solutions complaints were not resolved. The BBB had logged 57 closed complaints in the previous three years, including 35 closed complaints in the previous 12 months. In addition, in the first four months of 2013, there were eight Asset Recovery Solutions lawsuits filed in federal court alleging violations of the Fair Debt Collection Practices Act.

Stop Debt Collector Harassment

If you are being harassed by debt collectors, you should be aware that there are rights afforded to you under the Fair Debt Collection Practices Act. Created by Congress in an effort to put an end to unethical and abusive collection practices, the FDCPA outlines acceptable behaviors by debt collectors – whether from Asset Recovery Solutions or any other debt collection agency – and limits the ways debt collectors communicate with consumers in their efforts to collect debt. Under the FDCPA, debt collectors are allowed to contact third parties to determine the location of consumers, such as calling family members and friends. However, when contacting a third party, a debt collector – again, whether from ARS or any other agency – may only state that he is verifying or updating his contact information, and if the third party asks, he may give the name of his employer. Debt collectors must also provide validation of the debt they are attempting to collect if the consumer disputes the debt within 30 days of initial contact. If a debt collector is unable to provide validation of the debt that they are trying to collect, they must cease their collection efforts until they are able to do so.

If you are being harassed by a debt collector, you may hire a lawyer to file suit against them for failure to follow the provisions of the FDCPA. If found in violation, they could be forced to pay up to $1,000 in damages, as well as attorney’s fees and court costs.
